1. Interpretation and Definitions

1.1 Interpretation

Capitalized terms have the meanings provided in this Section or otherwise defined in these Terms. The definitions apply regardless of whether terms appear in singular or plural.

1.2 Definitions

• Affiliate means any entity that controls, is controlled by, or is under common control with the Company, where "control" means direct or indirect ownership of at least fifty percent (50%) of the equity interests or voting securities.
• Application means the web application titled "Recepto AI," including all related features, tools, content, and updates.
• Company, We, Us, or Our means GenSOFT s. r. o., registered at Športová 608/4, Viničné 900 23, Slovak Republic, IČO: 57 162 981.
• Device means any device capable of accessing the Service.
• Service means, collectively, the Application, the Website, associated software, content, AI-powered tools, and any services offered by the Company.
• User Content means any recipes, ingredients, text, metadata, or other content uploaded, submitted, or transmitted by You through the Service.
• Website means the Recepto AI web application and any associated subdomains.
• You means the individual using the Service or the legal entity on whose behalf the individual uses the Service.

2. Agreement to Terms

Your access to and use of the Service is conditioned upon Your acceptance of these Terms and the Recepto AI Privacy Policy. By accessing or using the Service, You acknowledge that You have read, understood, and agreed to be bound by these Terms. If You do not agree, You must discontinue use of the Service.

3. Eligibility; Age Requirements

You represent and warrant that You are at least 16 years old, in accordance with the Slovak implementation of GDPR Article 8 regarding the age of digital consent.

If You are between 16 and 17 years old, You may only use the Service with the consent and supervision of a parent or legal guardian, who agrees to be fully responsible for all activities conducted using the Service.

4. Recipe and Nutrition Disclaimers

Recepto AI does not provide medical advice, nutritional counseling, or professional health services. All recipes, calorie estimates, nutritional insights, and food suggestions are AI-generated approximations and may be incomplete or inaccurate.

• Recipe suggestions and nutrition estimates are approximations only.
• The Service is not intended to diagnose, treat, cure, or prevent any disease.
• You should consult licensed professionals for dietary or medical guidance.
• The Company is not liable for inaccuracies in recipes, calorie counts, or ingredient suggestions.
• Always verify ingredients for allergens before preparing any recipe.
• Dietary preference, allergy, dislike and "cooking for kids" settings are inputs to an AI model and are applied on a best-effort basis only. They are not a guarantee that generated recipes are free of a given ingredient or allergen.

Recipes for infants and children: Age-related modes (such as baby, toddler, lunchbox or picky-eater settings) are general inspiration for the adult preparing the food. They are not paediatric, weaning or infant-nutrition advice. Always consult a paediatrician or qualified professional before introducing new foods to a baby or child, and take care with choking hazards, allergens and food safety.

5. User Content; License Grant

By submitting User Content, You represent that You own or have rights to it. You grant the Company a worldwide, royalty-free, transferable, sublicensable license to use, reproduce, analyze, process, modify, publish, and create derivative works from the User Content to operate and improve the Service, including training AI models.

This license is revocable. Upon deletion of Your Account, the Company will cease using Your identifiable User Content within 30 days, except where: (a) retention is required by applicable law, or (b) the data has already been anonymized and incorporated into AI models. You may also opt out of AI training specifically by contacting Us at andrej@receptoai.com.

You agree not to upload unlawful, harmful, offensive, or infringing content.

6. Community Features and Public Content

The Service includes social features such as public user profiles, display names, profile pictures (avatars), following other users ("Cookmates"), published recipes, ratings and recipe questions. Content You publish through these features, together with Your display name and avatar, is visible to other users and may be publicly accessible on the internet, indexed by search engines and shared through public links.

Do not publish anything You would not want to be public. If You upload a profile picture, You confirm You have the right to use that image. We may remove content or avatars that breach these Terms, and You may delete Your published content at any time from Your account, although copies may temporarily remain in caches or backups.

7. Fees and Service Communications

The Service is currently provided free of charge. We may introduce paid plans or usage limits in the future; any such changes will be announced in advance and will not apply retroactively to use already made.

We send service-related emails (such as account, security and transactional messages) that are necessary to operate the Service. Optional emails, where offered, can be turned off using the unsubscribe link in the message or in Your account settings.

Generation of recipes, images and answers uses AI capacity, and We may apply fair-use limits or temporarily restrict generation to protect the Service.

8. Prohibited Uses

You agree not to:

• Upload violent, explicit, or unlawful content
• Reverse engineer or conduct competitive analysis of the Service
• Circumvent protections or gain unauthorized access
• Upload content that infringes on intellectual property rights
• Interfere with the Service's operation
• Use the Service for any illegal purpose
• Attempt to scrape or extract data from the Service
• Use the Service to generate content that is misleading, fraudulent, or harmful
• Create multiple accounts to circumvent restrictions or bans
• Impersonate another person, or use a display name or avatar that is misleading, offensive, or infringing
• Harass, abuse, or spam other users through profiles, ratings, comments, or follow features
• Use automated tools to generate recipes or requests at a volume that burdens the Service
• Submit another person's personal data (including information about children) that You are not entitled to share

9. Account Registration and Termination

To access certain features of the Service, You may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

You are responsible for safeguarding Your account credentials and for all activities that occur under Your account.

Your right to terminate: You may delete Your Account at any time through Your account settings or by contacting Us at andrej@receptoai.com. Upon deletion, We will remove Your data in accordance with our Privacy Policy.

Our right to terminate: The Company may suspend or terminate Your access at any time if You violate these Terms. We will provide reasonable notice where possible, except in cases of serious violations. Upon termination, all rights granted to You immediately cease.

10. Third-Party Services

The Service may include links or integrations with third-party content or services. The Company does not control and is not responsible for such services.

11. Intellectual Property

All rights in the Service (excluding User Content) are owned exclusively by the Company or its licensors. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service.

12. "AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided without warranties of any kind, express or implied. The Company disclaims all warranties including merchantability, fitness for a particular purpose, accuracy, and non-infringement. This does not affect Your statutory rights under EU consumer protection law.

13. Limitation of Liability

To the maximum extent allowed by applicable law, the Company's total liability shall not exceed the greater of:

• The amount You paid in the preceding 12 months, or
• One hundred euros (€100).

The Company is not liable for indirect, incidental, or consequential damages, including loss of profits or data. Nothing in these Terms excludes liability for death, personal injury, fraud, or any liability that cannot be excluded under applicable law.

14. Copyright Infringement (DMCA)

If You believe that content available through the Service infringes Your copyright, You may submit a notice to Our designated copyright agent:

Your notice must include: (1) identification of the copyrighted work, (2) identification of the infringing material and its location, (3) Your contact information, (4) a statement of good faith belief, and (5) a statement under penalty of perjury that the information is accurate and You are authorized to act on behalf of the copyright owner.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Slovak Republic, without regard to its conflict of law provisions. Where You are a consumer within the EU, You also retain any mandatory protections provided by the law of Your country of residence.

16. Dispute Resolution

Any disputes arising from these Terms or Your use of the Service shall first be resolved through good-faith negotiation for a period of at least 30 days.

If negotiation fails, disputes shall be submitted to the competent court in Bratislava, Slovak Republic, under its rules then in effect. The language of proceedings shall be English.

EU consumers: Nothing in this section prevents You from bringing proceedings before the courts of Your country of residence. You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

17. Severability and Waiver

If any provision is invalid, the remaining provisions remain in effect. Failure to enforce a right does not constitute a waiver.

18. Changes to These Terms

The Company may update these Terms at any time. Material changes will be announced through reasonable notice at least 14 days before they take effect. Continued use after updates constitutes acceptance.

19. Language of These Terms

The Service is offered in several languages. These Terms are drafted in English, and the English version prevails in the event of any discrepancy with a translation.
